Terms of Service

Mailsim is a service operated by FAR INDUSTRIES LLC ("The Company," "we," "us," or "Mailsim"). We reserve the right to update these Terms of Service at any time without prior notice. Your continued use of Mailsim constitutes your acceptance of the most current version of these Terms.

1. License and Usage Rights

We grant you a limited, non-exclusive, non-transferable license to access and use Mailsim for your internal business purposes. This license does not constitute a transfer of ownership. Under this license, you agree not to:

• Copy, modify, or create derivative works based on the Service or its materials;
• Reverse engineer, decompile, or disassemble any part of the software powering the Service;
• Remove or alter any proprietary notices, trademarks, or branding from the Service; or
• Redistribute, sublicense, or make the Service available to unauthorized third parties.

Violation of any of these restrictions will result in the immediate and automatic termination of your license. We may also revoke your access at our sole discretion at any time.

2. Disclaimer of Warranties

Mailsim and all associated materials are provided on an "as is" and "as available" basis. We make no warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not guarantee the accuracy, completeness, or reliability of any results, data, or materials delivered through the Service.

3. Limitation of Liability

Under no circumstances shall The Company, its affiliates, or its service providers be liable for any direct, indirect, incidental, consequential, special, or punitive damages — including but not limited to loss of data, revenue, profits, or business opportunities — arising from your use of or inability to use the Service. This applies even if we have been informed of the possibility of such damages. Certain jurisdictions do not permit the exclusion or limitation of liability for incidental or consequential damages, so these limitations may not fully apply to you.

4. Accuracy of Materials

Content and materials on Mailsim may contain technical inaccuracies, typographical errors, or outdated information. We do not guarantee that any content is accurate, complete, or up to date. We reserve the right to make changes to the Service and its materials at any time without obligation to notify you or update previously published content.

5. Description of Service

Mailsim is an email warming and deliverability platform. The Service facilitates automated email interactions ("Warming Activity") between your connected email accounts and Mailsim's pool of warming accounts. Warming Activity includes sending emails from your account, receiving replies, moving messages out of spam folders, marking emails as important, and other positive engagement actions designed to improve your sender reputation with email providers.

You are solely responsible for configuring the volume and frequency of Warming Activity, including any default settings presented by the Service. Mailsim is not liable for any adverse consequences resulting from your configuration choices, including but not limited to domain blacklisting, account suspension by your email provider, or deliverability degradation caused by excessive sending volume.

Mailsim is not responsible for service interruptions caused by third-party providers, including but not limited to email provider outages, OAuth token revocations, or SMTP disconnections. If your email account becomes disconnected, Warming Activity will automatically pause until the connection is restored.

You are responsible for actively monitoring your Mailsim account, reviewing platform notifications, and responding to any alerts — particularly those related to disconnected accounts or actions required to maintain uninterrupted service.

6. Billing and Payments

Mailsim offers paid subscription plans — Starter, Growth, and Scale — each with defined feature limits and pricing. Current plan details and pricing are available at https://mailsim.io/pricing.

Subscriptions automatically renew at the end of each billing cycle (monthly or yearly) unless canceled before the renewal date. All payments are processed through Stripe.

All charges are non-refundable. No refunds or credits will be issued for partial use, unused periods, early cancellation, or account deactivation during an active billing period. Yearly subscriptions are non-refundable once payment has been processed.

A promotional trial period may be made available through a coupon code. At the end of the trial, your subscription becomes active and applicable fees will be charged automatically.

Yearly billing is available at a discounted rate and can be selected during checkout or upgraded from within your dashboard. Prorated charges or credits may apply when upgrading your plan mid-cycle.

If payment is not received within 14 days of the due date, we reserve the right to suspend or permanently delete your account, including all associated data.

You are responsible for ensuring that the email address associated with your Mailsim account is valid and actively monitored, as we will use it to deliver invoices, payment notifications, and account-related communications.

By adding a payment method, you authorize us to charge your payment method for any active or pending subscriptions, including subscriptions transitioning from a trial period. We may also attempt to collect any outstanding balances using your most recently added payment method.

7. Cancellation

You may cancel your subscription at any time through the Billing section of your dashboard or by contacting us at info@mailsim.io. Upon cancellation, your subscription will remain active until the end of your current billing period. No refunds will be issued for the remaining time. We may require identity verification before processing account deletion requests.

8. Modifications to Terms

We may revise, amend, or replace these Terms of Service at any time at our sole discretion. Changes become effective immediately upon posting. Your continued use of Mailsim following any updates constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

9. Governing Law

These Terms and any disputes arising from your use of the Service shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law principles.

By using Mailsim, you agree to comply with all applicable laws and these Terms. In return, we commit to providing a reliable service and transparent communication.
